Filing a Protest:
2 AAC 12.200 - Notice of Intent to Award. Notice of intent to award does not constitute a formal award of a contract. The notice of intent to award must include: (1) a statement of the bidder's right under AS 36.30 to protest the award, including the time within which the protest must be received; and (2) the name of the successful bidder.
A bidder who wishes to protest this Notice of Intent must file a protest within ten (10) calendar days following the date this Notice is issued. If the tenth day falls on a weekend or holiday, the last day of the protest period is the first working day following the tenth day.
Protests must comply with the requirements of AS 36.30.560:
An interested party may protest the award of a contract, the proposed award of a contract, or a solicitation for supplies, services, professional services, or construction by an agency. The protest shall be filed with the procurement officer of the contracting agency in writing and include the following information:
- the name, address, and telephone number of the protester;
- the signature of the protester or the protester's representative;
- identification of the contracting agency and the solicitation or contract at issue;
- a detailed statement of the legal and factual grounds of the protest, including copies of relevant documents; and
- the form of relief requested.
Bidders, identified here as the apparent low responsive bidders, are instructed not to proceed until a Purchase Order, Delivery Order, Contract Award, or other Notice of Award is received from the state. A company or person who proceeds prior to receipt of a Purchase Order, Delivery Order, Contract Award, or other written Notice of Award does so without a contract and at their own risk. AS 36.30.365.
